In accordance with the Decree of the Cabinet of Ministers of the Republic of Uzbekistan № 708 dated October 28, 2024 “On approval of the regulations on the order of pre-judicial sanitation with the provision of state support”, starting from December 19 this year launched a state service to conduct pre-judicial sanitation with the provision of state support through the Public Services Centers under the Ministry of Justice and the Single Portal of Interactive Public Services (hereinafter - SPIPS) my.gov.uz.
In order to take advantage of this service, the head of an enterprise that has signs of insolvency, or a person authorized to submit an application on its behalf:
- Can apply to the Public Services Centers in person or registers on SPIPS to receive the state service electronically (link to get the service);
- In case of applying to the Public Services Center in person, the employee of the Center submits an application on behalf of the applicant, and when applying through SPIPS, the applicant independently fills out the application in electronic form and attaches to the application the documents stipulated by the procedure approved by the resolution.
Pre-judicial sanitation with state support is introduced based on the decision of the State Assets Management Agency for a period of 12 to 24 months.
The decision of the State Assets Management Agency is issued with a QR code and is sent either to the Public Services Center (in case of personal appeal) or to the head of the enterprise via SPIPS (in case of electronic appeal).
During the sanation period, a special sanation account is opened for the enterprise in a bank and no encashment is imposed on this account.
It should be noted that this procedure, approved by the Resolution of the Cabinet of Ministers, is aimed at supporting business entities in financial difficulties, giving them the opportunity to postpone payments to creditors and restore solvency by attracting funds from external and internal sources.
In order to use this state service, it is necessary to select the service “Conducting pre-judicial sanitation with the state support” on the portal my.gov.uz and fill in the application form. The service is absolutely free of charge.
