On 18 May this year, the Senate of the Republic of Uzbekistan approved the draft law ‘On an addition to the Code of Administrative Responsibility of the Republic of Uzbekistan in connection with the strengthening of responsibility for violations of legislation in the sphere of lease of state property’, developed by UzSAMA.
The Draft Law supplements Article 2158 of the Code of Administrative Liability (violation of legislation in the sphere of lease of state property), according to which the lessee is liable for leasing state property without concluding a lease agreement in accordance with the Law. For violating the legislation by unreasonably preventing the lessee from obtaining leased state property, entering the territory of the leased property and using it, or misrepresenting in the lease agreement the parameters and quantity of leased state property:
- impose fines on officials - from 5 to 10 times the amount of the basic calculation value;
- If the same offence is committed repeatedly within a year after the application of an administrative penalty, officials shall be fined from 10 to 15 times the amount of the basic calculation value.
Adoption of this draft law will prevent violations of the law when leasing state property and ensure the inevitability of punishment for offenders, create transparency and a healthy competitive environment when leasing state property, and guarantee the rights of business entities.
